Disregarding capital -divorce settlement Fri 06-Feb-09 10:08 AM
Could anyone advise me on this query please?
I have been contacted by an advocate on behalf of their client who is very ill with MS. The Court has awarded her a lump sum specifically to meet her housing needs to be met from the sale of her former matrimonial home (the money is to purchase a home with a small amount to furnish it).
I understand that the DWP has discretion to ignore this money for a period (understood to be 26 weeks) as opposed to considering it to be perhaps savings so that this lady can hopefully purchase a property - however her former partner does not want to sell the house given the current housing market situation and has instead offered to fund the settlement figure through a bridging loan - can this sum of money still be disregarded by the DWP? The client is currently in social housing which does not meet all of her needs because of her severe disabilities.
