SDPremium + student "non dependant"
Tue 24-Jun-08 08:13 AM

Single parent claimant on DLA MRC and IS. Daughter about to go to University. She will live in college during termtime: main home with parent during holidays. Is she ignored during term time so that Mum can claim the SDPremium during termtime on the IS Regs Sched 2 para 13 grounds "no non dep over 18 normally resides with her" (but not holidays when presumably daughter will count as a non dependant ??)

If so, next year ,when daughter lives out and has to rent accommodation on a 12 month basis is it then accepted that daughter's main home is not with Mum so that Mum can claim SDP throughout the rental period.

Cant find anything in Bonner (IS Reg 3) to help in determing whether daughter in this situation "normally resides with " Mum. Has anyone come across this please?
