Would anyone happen to have a copy of this decision that they could either fax or email to me?
I believe that this was a case where it was held that where disclosure was alleged by claimant it was not enough for the Dept. simply to say that "we don't have any record of that therefore it did not happen". Rather they must put evidence about procedure for recording disclosures, how far in practice they are followed etc.
I have a copy of R(SB)10/85 which approved this decision (thanks to Rob for faxing it to me) but I would like to see the original case as the reported case does not give any details.
