CA Fraud Charge with Overpayment Appeal due to be heard Sun 25-Jun-06 02:12 AM
Client's CA stopped with an alleged overpayment because AA recepient "not entitled" due to "fraud" awaiting court. Decision CA appealed, recepient of CA now accused of fraud but appeal hearing date arranged.
My view is that provided carer afforded 35 hours per week to AA recepient and fulfilled other fundamental conditions then DWP will find it difficult to show causative link re allegedc overpayment and that CA recipient failed to disclose or misrepresented material fact
