Incapacity Benefit for prisoners on remand?

Help required from people working with prisoners on a regular basis. If payment of Incapacity Benefit is suspended pending a decision re a conviction, can someone who becomes ill whilst in prison make a new claim?

Incap isn't payable at all while some one is in prison - even on remand. While on remand it is suspended pending any outcome. If there is no custodial sentance then all that happnes is that you need to get in touch with JC+ (verification is always helpful). Payment is then reinstated. You need to allow for all the normal hiccups though.

I suppose the short answer is no.
