appealing to the upper tier tribunal
Fri 13-Feb-09 09:28 AM

Good morning welfs

I'm about to make my first appeal to the upper tribunal. Are there any significant changes that I should be aware of? Or is it all pretty much the same as it was before November?

I'm sure others will give the legal jargon, but the tone of your question doesn't suggest that's what you're looking for.

So, with that in mind, it is all pretty much the same. Same chairs, same venue, same clerks, same time, etc, etc.

If you want to know whats legislatively different, you'll need to check out the tribunal procedure rules, etc. Search Righsnet news stories or other recent threads - its all there.

Sorry Jan, not had time (go to fax off stuff for a tribunal on friday) to check LASA training wotsit, but in the past they did a 'after the appeal' and 'finding errors of law' basically taking cases to commissioners (was well worth the dosh).

But the other thing that struck was Mark Perlic did a powerpoint wotsit at one of the NAWRA events 'up country' which is worth reading in its own right (on the NAWRA website) and appeared to give some really good sounding handouts on taking cases to commissioners. Food for thought for NAWRA i.e. liaising with skilled practitioners/trainers to organise training regionally.

Anyway going back to the present 'appealing to the upper tier tribunal' i too could really do with training.

I always get my training from CPAG - I happen to find them v. good though I am sure there are other providers; I haven't found them...

There is a course that also deals with appeals to the upper tribunal on page 23 (with an additional 'JR function' of the UT on page 24) of their current training handbook - see (and I hope the link works! Otherwise just try CPAG.org.uk and follow the links):

Have only one case post-changes but so far seems to be pretty much the same. I did note that the UT1 form was optional and put my appeal in by letter which saved time and paper - but then the OSSC1 might have been optional all the time and I never noticed.
