Any new decisions on losing R2R for lone parent A8 national?

A8 nationals who stop work to have their baby no longer have a right to reside because they are no longer looking for work and are "economically inactive". I rarely deal with this kind of enquiry so I need some help, as in the title of the post.
Client self-employed for over a year. Gave birth in October 06 and was advised (!) by her accountant to write to JC+ that she has "terminated" her self-employment. JC+ rejected her IS application and told her that she no longer has a R2R. HB stopped, client issued with section 21.
Client has re-registered as self-employed person (she is a mobile hairdresser, so nice haircuts for for us if we help!)- so I presume she can put in a claim at least for HB + Tax Credits, right? But is there any new ways to challenge loss of R2R?

If she's self-employed and working less than 16 hours a week she could still qualify for IS subject to the means test, can't she? As long as the work is not too insubstantial.

Me, I'd complain to clever-dick tax adviser if she's lost out. Hope he's insured. But then that's the lawyer in me thinking.

As she has re-registered as self-employed, she regained her R2R and applied for IS. Managed to obtain a document that she in fact visited another accountant/ tax adviser in May 07 to enquire whether she needs to re-register and expressed her wish to do so. Filed necessary accounts, so had a back up of evidence of self-employment. Requested backdate (severe post-natal depression prevented her from applying in time). Got IS, full HB, retained home.
There was still hovewer a period of Oct 06 till May 07 when her R2R was non-existent and I did not find a way to jump over this.
