My client was getting DLA MRC until recently when the entire award stopped. She is getting WTC with disability and severe disability elements.
On my advice, client contacted TCO to report the CoC, but her TC was increased! She is till being paid both disability elements.
Today, on my advice she rang again and was told that as long as she continues to take tablets for her MH problem her award is correct. Client says she unequivocally made it clear that is not recieving DLA.
The DE might be OK on a previous IS claim but the SDE is definitely not OK.
So, client has reported her change of circs twice and has been misadvised by HMRC. What would you do, or advise the client to do, now...?
