Recovery of Overpayment from ongoing benefits
Thu 17-Nov-05 09:10 AM

Hi
I wonder if anyone can give me a definitive answer on this one. I have a client who has an overpayment of DLA through failure to disclose a change of circumstances. She is currently in receipt of IB and IIDB only (partner works). Can DWP recover off both benefits or can they only recover off one or the other? Benefits are paid seperately.
I'd appreciate any comments.

My reading of regs 15-17 SS(PAOR)regs, suggests that there recovery can be made from both benefits with no limitations. Reg 16 is quite difficult though and there is no commentary to it in Rowland. However, I can't find any reference that reg 16 applies to IIDB, but there is a limiation of IB is paid concurrently with IS.

I couldn't find the reference in DMG, but probably worth a look.

Thanks for input, Tony. I'll give it a look.
