DLA and continuing health care funding

Client is in a specialist residential setting and gets continuous health care funding.

Does the mobility component of DLA stop as well as the care component as mobility is normally paid in residential care providing of course he can benefit from the enhanced facilities for locomotion?

Or is he still classed as being "in hospital" and therefore loses the mobility component. I feel its the latter but would appreciate any comments.

I'm afraid you're right - neither component of DLA is payable in these circumstances for the reason you indicate. Your client is treated as a hospital inpatient because his treatment, care, & accommodation costs will be fully NHS funded (see CPAG WBH p612). The same scenario happended to a relative of mine. Couple of caveats to the above. You continue to be paid your mc if you have a Motability agreement. When your agreement ends so will your mc, unless you renew it under the Wheelchair Scheme. If you have been a patient since 31/7/1995 you contine to be paid your mc, albeit at the lower rate.
