Please could someone point me in the right direction for any case decision in respect of commercial agreements. The scenario is a Lady renting from her Daughter. There has not been any rent paid and the property was bought by the Daughter to prevent her Mum having to present as homeless.
Daughter could not keep up with the repayments on the mortgage so re-mortgaged with another Daughter.
5 years later a tenancy was signed (the Council said come back in 5 years at the first attempt). The agreeement was signed and no rent has been paid and no legal action taken.
Therefore anybody have any pointers for any decisions and the pitfalls to be aware of.
