LHA and child benefit

My client has problems with CB which we are dealing with through an official complaint. She was given ILR in June and applied for all benefits after that - she is a SP with 3 children. She has only been awarded CB for one child to date - others still subject to PFA checks, hence our complaint.

She has been awarded LHA based on a 2 bed - her need is for a 3 bed. The only reason I can think of is because of her CB problem - I have written to LA bit have not had a response yet.

I tried to check in LHA regs but could not find whether CB is needed as proof of responsibility for a child when assessing LHA - can anyone assist?

You will find the answer in the 2006 main HB Regs Reg 20 and 21.

CB is not necessarily needed as proof of responsibility
