I've been sent a copy of the above decision by OSSC.

Its the CPAG case decided by a Tribunal of Commissioners about children and learning difficulties although it goes further and deals with the (lack of) a medical diagnosis for DLA claims.

I'll email a copy if you want one (or I can post it to rightsnet if someone gives me an e-mail address).

At first reading, this is an excellent decision for all those children with ADHD - the young lady referred to sounds so very similar to a couple of dozen children we have had as clients over the recent past, and much of the content will be invaluable in future submissions.

It's also good to have up to date firm guidelines set out on children attending hearings. The last time a tribunal asked us to take a child to a hearing, she said afterwards that it was the first and last time she would ever do anything like that - she said they talked down to her the whole time and not only made her feel like a five year old, but also gave her the distinct impression they didn't believe her.
