The new Statutory Instrument 2006 2897, as given in the latest "News" section, says in the explanatory notes "Regulation 2(a) provides that a person who is required to apply for a national insurance number because he is an employed earner or self-employed earner must provide a document described in Part 1 or 2 of the Schedule to the Immigration (Restriction on Employment) Order 2004." This seems to suggest the resitriction only applies to EMPLOYED EARNERS (plus the second bit about students) BUT an earlier news item(see copied bit below*) suggested the new SI would cover ALL applicants for NIno's who have no right to LIVE or work in the UK. Up til now I understood that the DWP's "SNAP" guidelines allowed someone to apply for a NIno even if they were not working, in order to protect a right to benefits.
