I have a client on IB 92.50 who applied for DLA in past and at same time we put in claim for IS in case he got MRC knowing it would initially be turned down due to excess income. He didn't get MRC so we obviously accepted he had no entitlement to IS. He's now making claim for CA and we've again put in claim for IS so that it will be paid once he gets the CA. Underlying entitlement will go back three months but not the IS as it's only just been claimed again. Could we ask for a supersession of the original IS claim do you think or is that wishful thinking?

No supersession possible on a refusal of benefit decision (the claim ceases to exist after it is refused).

May be some revision provision you could use?

Could you post with dates of the various claims and decisions?
