Indian/ Sikh family finance arrangements
Sat 16-Oct-04 04:58 PM

This possibly sounds bizarre but I need to appeal against an undisclosed savings based I/S refusal decision. Does anyone have any specific expertise/ knowledge of culture specific arrangments for family finances in a Punjabi speaking Sikh family? Would it be seen as 'normal' for a mother to have her adult son's money in her account but with no personal call on it (with no 'offocial' trust in place)? My client and her (independant, professional) care worker tell me it is and it's a line I'd like to try to follow but need expert advice. Thanks.

I wouldn't claim to be an expert, but I've seen similar arrangements several times. Winning the appeals usually turns on how coherent the explanation is, and how willing the tribunal is to accept what by traditional British statndards may seem a bizarre arrangement.

In terms of getting expert advice, I recently had success at a tribunal using an opinion on Islamic law from someone at a local mosque. Might be worth approaching the relevant temple or Gudwara for an opinion on the relevant cultural issues.
