IS suspended - savings problem..
Fri 19-Jan-07 01:54 PM

Hi,

A colleague just phoned me with this one, so info maybe a bit sketchy and its not my field, so im hoping the good and highly intelligent people on here can assist...

A client has had her income supoprt suspended, the DWP say this is because she has £100;000 of savings... However, these savings are tied up in some sort of investment and do not belong to her (im assuming though that the investment thing is in her name).. apparently the money belongs to someone else and she has a written document to proove this..

The problem is - the document is in Greek...!

She has had it translated into English but the DWP will not accept this... so, how can she proof the moeny isnt hers...

My thoughts are:

1. Take the original Greek document and take to a solicitors, getting them to translate and to sign an avi-davit stating the copies validity, but can you do this... and would there be a cost or would she be entitled to legal aid (or whatever its called these days)..

2. Are there any DWP regulations which allow for the DWP to pay for the translation..?

Sorry there is not much info and hope someone can help...!

From memory, (I don't think I am wrong), DWP has a translation service at Newcastle- run by the Pensions Service (TPS) I think.
The IS section may not be aware of this section as it usually translates birth/marriage certs etc for TPS.
The problem as I see it, isn't that the docs are in Greek, it's proving that the money's not the customers.
If it's not the customer's, the IS section are understanbly asking- 'Why is it in her name?'
