Am hoping to reach some advisers who have expertise in this area!

Basically my client has CAPD, which is designed to be carried out without help at home. However my client has other health problems including depression, social phobia and anemia which signicantly impair his ability to manage the dialysis. His partner helps him with the dialysis in the following ways: orders equipment and arranges and takes deliveries, moves, opens, weighs and reocrds the dialysis exchanges and disposes of afterwards. On some occasions when he feels unable she performs the dialysis.

My concern is that the help is too remote to be in connection with bodily functions, and does his partner perform the dialysis regularly enough to qualify on this basis. On the supervision side, the fact is because of his mental health problems he would not perform the dialysis left to his own devices so would this satisfy the supervision rule?

I think that mental health idea is the best way in myself, but it's not a supervision need it's an attention need to encourage someone to do something they could physically perform but do not due to their mental condition. CSDLA/130/02 strikes me as the clearest decision in that regard, paras 11-13.

When I used to work for Kent Social Services many years ago their benefit officers produced an excellent checklist about CAPD and DLA/AA. I have a copy of it so if you give me a fax number or snail mail address I'll send you a copy.

I (stupidly) did not take a copy of the checklist Sue faxed me before completing it with my client, so can't help I'm afraid. If Sue is not out there at the moment, it might be worth contacting Kent Social Services, not least because the checklist was very good. Sorry I can't be more helpful.
