CTC and payments under sec.17 of Children Act 1989
Fri 30-Jan-04 10:43 AM

a client receives a 'relative carer allowance' under sec. 17 of Children Act 1989 for a grandson she cares for. She also receives CB for him. Can she claim CTC in addition or is she seen as not responsible for him for tax credit purposes?
Some help would be greatly appreciated.

To get CTC you have to show that you are responsible for a child. You are responsible for a child if the child normally lives with you.

If the child lives with his grandmother CTC should be paid.

Hope that helps

thanks very much for that. I was looking at the info I had about CTC not being payable in certain circs (see below) and wondered if that applied, but I don't think it is relevant to this case.

A child or qualifying young person will be treated as not being the responsibility of any person (and therefore CTC cannot be paid to anyone in respect of her/him) if s/he:-

is being fostered or adopted under a local authority arrangement and the local authority is paying for her/his accommodation and/or maintenance
