non-dependant couple Wed 06-Jan-10 12:02 PM
Hi I have a query where the HB claimant has a non-dep couple in the property. One of then is in employment and earns £219 per week gross which would be £23.35 deduction and his partner is on Maternity Allowance of £120 per week. Is it correct to simply add the two gross incomes together to get £339 per week = £43.50 deduction or does the fact she is not treated as being in renumerative work mean that she can only attract the lowest deduction. This would mean £23.35 plus £7.40 = 30.75 per week?

Assuming the clmt is u-60, HBR 74(3)&(4) applies.
In short, the income is aggregated (74(4)). And, as one is in remunerative work, the higher deduction (based on £339) applies. Only one deduction applies though - the couple counts as "one" non-dependant in that context.
