Does anyone know what legislation covers claims for Maternity Grants?

As far as I can tell it isn't the standard claims and payments regs, nor the SFMFE(regs)2005.

This is important because as far as I can see sure start maternity grant is not subject to the NINO requirements... Anyone know otherwise?

Section 138(1)(a) of the Social Security Contributions and Benefits Act 1992 appers to refer.
Also, to be entitled to a SSMG, there has to be entitlement to a qualifying benefit/entitlement - where a NINO is required.

Thanks for your reply Mick. S.138 makes the initial provision for payments out of the social fund for the specified expenses, it doesn't cover making claims.

The qualifying benefit is already in place. I want my cliet to omit her partner from the application form as, in the (so far) absence of any rules about claiming, the only reason partner is on the form is to determine if it is the partner in receipt of the qualifying benefit - which isn't the case for my client.

Benefit is defined under reg 2(2) of the Claims and Payment Regs which then refers back to section 138. So claims for maternity grants are covered by the provisions of the C&P Regs.
