Right to reside in the Republic of Ireland

The right to reside amendments from May of 2004 are worded so as to require a claimant to have a right to reside in:

"the United Kingdom .... or the Republic of Ireland"

Does anyone know enough of Irish law to work out who might have a right to reside there?

If that law is much wider, can we take advantage of it for people who have never resided in Ireland at all (although they may have a right to)?

Hi Martin, Still out here! But sadly not too au fait with the UK stuff any more. What you might be looking at is the Government of Ireland Act 1949, which, I think has the effect of allowing UK and Eire residents to reside in each other's territories without being 'aliens'. Sorry it's very late, but i have not surfed in for some time.

Not to worry Aidan.

As far as I can figure out Ireland has similar provisions to UK for which EU nationals have a right to reside there (not surprising given that it all goes back to EU law).
