""Available"
(1) This means available to the claimant and other members of his household. We agree with the Commissioner who in paragraph 10 of the decision the reference to which on Commissioner's file is CSB/349/1983 wrote:
"Accommodation is not available to a claimant if for whatever reason he is unacceptable as a tenant to a landlord."
(2) Photocopies of lists of accommodation advertised in the newspapers, of the type commonly produced by the benefit officer in appeals before the SBAT, are simply lists of properties in respect of which the landlords are inviting offers. They are not offers which are capable of acceptance so as to form a contract. They are simply invitations to treat. Such an invitation does not make property "available" for the purposes of the condition in regulation 10(1)(a).
(3) It is for the claimant to show that a particular property advertised for sale which appears to be suitable for his needs is not in fact available to him. For this purpose, it is not necessary for him to show that he has visited and been rejected by every landlord of suitable property, provided that he can show by his efforts to obtain such accommodation that, in practice, it is not available to him."
