requesting IB medical reports for DLA
Tue 14-Dec-04 07:52 AM

I wonder if anyone has experience of requesting an IB medical report to use as evidence in a DLA appeal?

I have a client who passed the PCA and I think the IB85 could have some useful information.

Is it possible to request a copy? Does any reason need to be given?

We have on several occasions used IB and SDA medical reports as evidence, particularly where we have had an EMP report that is more abysmal than usual - these medicals are (generally speaking) somewhat more thorough, and do normally give a description of the tests being carried out. The SDA reports are particularly useful as these require at least 80% disablement to get the benefit.

Just write to your local IB section giving the reasons - don't forget that the DLA are not above using a IB medical report themselves when they think they get a sniff of evidence of an improvement......

I tend to always ask for it if there has been a pretty recent one and have used them on a number of occasions for DLA claims. Like Mike says be wary that it can work the other way. There's a question on the DLA claim form asking if they've had a medical in the last 6 months for any other benefit and I've had a number of clients who've had their IB/SDA 'mysteriously' withdrawn when they've been refused DLA.

See CDLA/2998/2003 (On Commissioners site and in Rightsnet briefcase)which discusses the use of IB medical reports in DLA cases.

The DWP are making increasing use of IB85s themselves. The pilot project regarding different ways of claiming that they ran at Glasgow DBC for about 18 months recently utilised them as evidence for some claims.

Mike - I think "we" should be told!

Do you have a small library of Quotation guides, the complete works of shakespeare & Dickens, several years' compendiums of "Readers' Digest", etc. perched on your desk, next to the computer? !!!!

Either that, or do you not get out much?? I mean, I know Norfolk and the fens can be bleak, but .....!!

Happy Christmas matey, and to all other readers,
from Splott-Paul and Cardiff WRU

Splott Paul must be old enough to remember when Splott was so bleak that people denied living there and said they lived in Tremorfa.

Has Splott been gentrified so its now the Welsh capital's Islington or Notting Hill?

we're SO posh in Splo' now, we's calling it "Upper Bay"!

Would you, per chance, be referring to Lord Tremorfa - former agent to "Sunny" Jim Callaghan (former Prime Minister and MP for Kairdiv South & Penarth, for you young whipper-snappers) who is a son of the manse, but couldn't face being Lord Splott! ??
