IS paid a few days after client's husbands death to cover the eleven days up to his death. He was the claimant (purely for convenience as client could also have made the family's claim) and it has been treated as an asset of his estate and knocked off funeral grant payable. This was a substantial sum as included allowance for couple and three children (they hadn't transfered over to Tax Credits.) Reg 10(1)(a) appears to allow this. This must happen quite a lot. Has anyone had any success challanging the treating of IS arrears as an asset in similar circumstances?
