problem?- application for dla submitted on behalf of boy aged 2 years and 8 months at date of claim. application detailed mob problems and care/supervision needs. claim rejected - decision upheld by appeal tribunal which took place after 3rd birthday. trib considered award of hrm - statement of reasons obtained and possible errors of law disclosed query? did tribunal have jurisdiction to consider mob higher rate - obviously I do not wish to seek leave to appeal on the basis of their findings on the subject if district chair is likely to dismiss

The Tribunal only had jurisdiction to consider the appeal down to the date of the decision, not date of hearing ......
