DLA in special accomodation

Young person is due to take up a residential college place, funded by Social Services & LEA.
It seems care component will not be payable during time at college. How about holidays & weekends when the student will be going back to the family home? Is this subject to the 28 day rule?

As far as I understand the rules, when someone leaves special accommodation to go home for a weekend for example, they can put in a claim for the care element of DLA so long as there is an underlying entitlement.

I know of cases where residents go home sometimes at weekends and they claim for those times.

I would suggest the person concerned, or their representative, write to DLA explaining the situation either before a home visit takes place or after when they can put in a claim for the care element at the same time.

Thanks for confirming what I thought. I had advised the socialworker to do as you suggets.
I just couldn't find a regulation saying it was possible and that always makes me feel uneasy!

You need to check first how the stay in the accommodation is funded and in particular if it falls foul of Reg.9 of the DLA Regs. Whether the rule is 28 days or 84 days depends on how old they are. It's essentially the same as the hospital rules - see Reg. 10
