Joint and Several liability and Bnefit
Tue 14-Apr-09 01:47 PM

Hi, struggling with this one.
Joint Owners, both living in property, not a couple, she is in receipt of CTB for 50% liability. They chase him for other 50%, they get as far as court action and because nothing is resolved at court, decide to chase her for his 50%. Her argument is, if they are now chasing me for the full amount, surely they should give benefit for the other 50% as at the time she was getting benefit.
She actually received a letter from local council stating that as they couldn't retrieve the monies due from other party they were now purely chasing her.
Any help or ideas appreciated

As far as i can recall from my ctax days these is correct. She has 50% CTB for her 50% of the bill. That is all they will assess her for as there is other liable party. However because they both have joint and several liability for the whole bill if he doesnt pay up they can chase her for his 50% and not give her CTB for this.

Letter saying they won't accept money from someone else seems very odd and if he wanted to pay i'm fairly sure they would take it.

Isnt really fair but i don't think there is a way around it i'm afraid.

Hi, thanks for reply

Letter wasn't saying they wouldn't accept money from him, just that they had decided to stop chasing.

Seems very unfair to me, especially seeing as this went on for a few years and amounts to enough to go for bankruptcy, should they so wish to do so.
