V v Secretary of State
Mon 28-Mar-05 11:40 AM

Does anyone have access to a copy of V v SOS (23 Feb 2001)which (in part)reversed Commissioner Howell's decision in CDLA 835/97(*42/99)? I could do with it for a commissioner's case regarding DLA for a child & LRM.

there's a case mentioned on casetrack for that date - V (Child) Peter Gibson LJ , Mummery LJ , Rix LJ Case No: A1/2000/0119 - which i assume is it (?) ... but no transcript .... does the case reference help anyone else in locating it?

(checked the bailii listings for 2001 (@ http://www.bailii.org/ew/cases/EWCA/Civ/2001/) ... and nothing)

I think this was a client of mine, back in the days when I was still employable, about a child who was in 'moral danger' when walking outdoors unaccompanied. As far as I recall, my colleague Holiday Whitehead represented at Commissioners and then CPAG took it on when it went to the Court of Appeal. So I guess if you contact CPAG they should be able to provide you with what you need.

Good luck,

Steve

I was feeling generous so had a look round. OSSC site says it was reported as R(DLA) 7/99 but the reported decisions on DWP site only go as far as R(DLA) 6/99. Odd.

Thanks to both of you anyway - I had found the link to the reported decision that time forgot too! I'll follow up on the CPAG option, Mike
