Transcripts of appeal hearings

Quick question - are Tribunal hearings taped as a rule; or does it depend on individual area practices?
If they are can I request a transcript on behalf of client and myself? I did not attend a recent hearing but client did, and I understand from her that my professional conduct has been questioned by the Chair.

Tribunal hearings are not recorded (at least not in my experience) but you can request a copy of both the written statement of reasons and the chairman's record of proceedings.

The first tribunal hearing I ever attended, about eighteen years ago, WAS recorded, as were a few subsequently. It was quite a while before I realised that this was not common practice. I haven't seen a tape recorder at appeals for many years.

It might be an idea to request that the chairman explains what they meant. You could do that if it wasn't in the RoP, or maybe even request such a statement in any case when you make the request for RoP/SoR (so the matter is still quite fresh in the chair's mind). I don't know if that'd be a good idea though, _just_ in case your client's reportage of what happened is in any way inaccurate.

Most clerks issue the RoP at the same time as the statement, but they can actually issue it at any time when they've got the file back from the venue. If you separately ask for the RoP ASAP you should get it straight away.
