Hi, i have a client who has been informed by the Council that there is a huge HB OP of approximately £1021.55.

My client was recently widowed - his wife dealt with all the claims to benefit and did all the paperwork/bills etc as he is very dyslexic and had no idea what was being claimed and what information had been provided to make the assessment/award.

I have requested full details on the OP from the Council but wondered, if there is an OP would i be able to argue that my client was not party to the claim/info provided and should therefore not have to pay it back..........oh and there is no money in his wife's estate (in fact he is about £18k in debt with one thing and another!).

Before commenting further, it would be helpful if you can indicate what is alleged to have caused the o/p. e.g. undisclosed income? Capital?

Also, who was the actual clmt and who was the actual partner? Further did those roles change at any time during the o/p period? Also, did the partner sign the claim form (as a partner)?

The more info, the more accurate the advice.
