A a8 national has done a few months work and then falls ill for two weeks. He can't get SSP becuase he only earns £80 per week can he claim IS for this two weeks since it involves a break of less than 30 days?

Is his contract of employment still subsisting? And is it registered employment under the workers registration scheme? I can't see that, if he has a right to reside by virtue of being classified as a worker, he ought to be denied IS for a short period of illness, but I am willing to be corrected.
