Altercation at the Jobcentre
Thu 02-Aug-07 09:45 AM

My client was involved in an argument at the jobcentre when she says she was insulted and mistreated by staff. The JC manager has written in response to my client's complaint and rejected her allegations. The manager went on to make counter allocations of abusive behaviour and racist imsults.
A letter from a firm of solicitors acting for the DWP was also received by my client making similar allegations as were made by the JC manager and threatening ASBO and other sanctions.

My client is outraged. Can she do anything to clear her name?

Legal options include proceedings for damages for defamation of character or for the tort of misfeasance in public office. To succeed the claimant must show loss or damage, for example financial loss, loss of liberty, damage to reputation or, possibly, mental anguish. She needs to see a solicitor straight away if contemplating either, particularly in the light of a letter from the DWP’s solicitor’s office threatening legal action, which she needs to defend.

Has she any witnesses?
