income for tc purposes?
Tue 06-Jun-06 10:51 AM

hi, i wonder if anyone can help with this query.
Client claiming tax credits. Money is held in non-discretionary trust. Client is beneficiary, as are children.
Interest from trust is paid to client on regular basis - is this an income for tc purposes?
If interest is paid straight back into the trust, is this an income for tc purposes?
TC adviser helpline could not help with this one, said we need to write in for advice.

Quote from page 40 of notes that accompany a TC claim form:

"If you received income from a trust, settlement or a deceased person's estate, the trustees or administrators will have given you a certificate telling you what income was paid to you. Include the gross income."

I would assume that any such certificate should show what amount was paid to your client and what amount was paid to the children and the only income to include would be your client's and not the children's.
