I have a client who has 22 weeks worth of work. She is an agency worker and the shift she was working has finished. The agency are saying that they have no work for her (I will be advising her on sex discrimination etc., but assuming that they are bring honest...) if she keeps being available to work for the agency will she still be treated as being employed for the employment condition for MA?? I have looked at the statute but it just says "employed". My advice will be to try and find other work anyway, but just in case...
