ESA and full time students
Thu 14-May-09 09:39 AM

Wonder if anyone can clarify this for me - I'm sure it's straightforward(!). If an existing full time disabled student in receipt of IS or IB is reassessed under the ESA medical regime and awarded ESA and not getting DLA what would happen to their course? Is there any transitional protection for existing students?
Any help much appreciated.

Why would they be subject to the limited capability for work test rather than the PCA (at least for several years to come)?

The issue of transitional protection for those migrated over is unknown as yet because before a person can be migrated over secondary legislation has to be laid and this has not been done yet.

thanks for that. I was just a little concerned about those due to be transferred over from april 2009 and being overly pessimistic!
