Interchange of claims/ex gratia payments or what ? Tue 07-Mar-06 12:05 PM
My client's a carer for her adult daughter and also has residence order for her grandson (same daughter's child). She gets the usual benefits for him and is also on Widows benefit and GPC. I've recently advised her to claim underlying entitlement to CA. She has been daughter's carer and appointee for some years now and has been visited by DWP re appointeeship and also made claims for additional benefits when grandson went to live with her. She's also had many visits from Social Services and discussed (lack of)money with them. No-one had ever advised her to claim CA and I now want to try to get her some arrears for the many years she's been missing out. What's the best way to go about this? I assume I can't appeal the CA decision to backdate u/e for only 3 months due to strict backdating rules. Is the interchange of claims route relevant and if so to which dept do I apply - CA or the Pension Service re arrears of cp or either/both of them for an ex gratia payment ?
