my client a 40 year old woman was disallowed both the care and mobiltiy components of dla. currently awaiting surgery in next 5 weeks due to gynaelogical illness ie woman requires hysterectomy and has been unable to work due to gynaelogical pain and severe depression. have appealed and was wondering which health aspects should i concentrate on. emp report went against her after home visit.

In my experience the EMP's do not concentrate or really understand how mental ill health affects clients. They generally stick to the physical conditions and assess on those. Get as much evidence as you can from her support network, CMHT and GP.

In my experience CMHT clients are supplied with copies of their care plan and risk assessment: You could use those as additional evidence IF they are helpful (they aren't always).
