My client's CA overpayment tribunal has been held over pending a decision in the House of Lords in the Hinchy case.

She has however received a letter from the Appeals Service to say that although that ruling has now been made, there is another appeal to the Court of Appeal still pending which affects her case and prevents her appeal being listed.

I'm not sure what this appeal is. The background to the case is that my client failed to notify the CA office when she was awarded RP but did state on her RP claim form that she was in receipt of CA at the time of her application.

Anyone any ideas what the relevant outstanding appeal is?

is it B v Secretary of State for Work and Pensions - the appeal from the Tribunal of Commissioner's decision in CIS/4348/2003?
