Temp Acc and Council tax Benefit
Tue 23-Sep-08 11:31 AM

do any readers see people placed in temporary accommodation out of borough with council tax arrears due to not claiming CTB in the borough they are placed imn. I see lots and can't find out whether a HB claim to the placing borough should help...any thoughts gratefully received./

A claim for HB in one borough cannot legally count as a claim in another borough (for either HB or CTB).

The only realistic option available is via backdating.

There is one other option, but it's a long shot. You could try arguing that the two LAs should agree that the "placing" LA could be responsible for the administration of CTB for the "address" LA. There is a provision that allows for this, but, off the top of my head, it is descretionary. If I get time, I'll find therelevant provision & post what it is.

Thanks, that would help very much. This is a big problem.
