Tax Credit overpayment

Hi
I'm looking for someone who will take this to Judicial Review.
Foster carer - TC office wrongly awarded Child Tax Credit, resulting in £6,000 OP (we have got offset of WTC).
I am going through the challenging steps. Now at Adjudicater. But they have started recovery. They did suspend recovery when the TC846 went in but some time after they refused to waive the OP, they started recovery. Their guidance confirms this is the procedure and when i have spoken to them, they say they will only stop recovery action if we submit 'new evidence'.
I wonder if someone could take on a JR against the recovery of the OP whilst it is being disputed.
I am not after JR against overpayment as I am going throught the steps about that.

Thanks in advance

Clive

I was informed at the last consultation group meeting that recovery will be suspended whilst a complaint is within their processes or with the Adjudicator or Ombudsman.

If you want me to confirm that position I will do so.

I have had cases where recovery has been stopped - one where it went to the Adjudicator & the decision went against TCO; another still ongoing & with Adjudicator.

Thank you both.
John. I would be very grateful if you could do that. Is there already something in writing which I could use to stop the recovery now? Or, do you know who I could contact in the HMRC to get it stopped (perhaps quoting something at them - maybe the consultation group?)
Thanks

Nothing in writing to my knowledge.

If you send contact (phone) details to here or to the contact pages of www.litrg.org.uk. I will do what I can to direct you to the right people.
