Good question - i am actually have a jsa appeal on this matter next week where the client's ex-gratia payment was treated as income - he applied for contribution based jsa in march 07 and declined due to ex- grata payment generating an in income - however from 30/9/07 it has been treated as capital due to a change in legilation - i am appealing decsion not to treat as capital from march- september 07- i am finding it difficult to ascetain how it should hve been treated prior to september - they deparment have treated it as a compensation payment. - if i find futher clarity i will post in due course - would be obliged if you could do likewise - however if you case relates to payment after 30/9/07 you can be assured it should be treated as capital
