Claimant on Attendance Allowance in hospital -non dep deduction Thu 23-Nov-06 10:52 AM
Hi anyone know the answer to this one? I have a client who is currently in respite care on a temporary basis. They have been there for over 4 weeks so their Attendance Allowance has ceased. They have non-deps, is a non-dependant deduction now made from her HB & CTB.

Don't know the answer. The relevant reg refers to 'receiving' Attendance Allowance etc. The only similarity which immediately comes to mind is SDP qualification and 'in receipt of'.

Im still not sure about this as the only people who seem to be sure there should be a non-dep charge are the local housing benefit office! Not sure I trust whether they have actually researched this or just made a decision off the top off their heads!

Taking a tentative prod at this....
I think a non-dep deduction applies once AA ceases. It did cross my mind that there should be a 26 week delay; but that only appears to apply where the change in circs is that of the non-dep. In this case, the change is in the CLMT'S circs, not the non-dep's.
But, the wording of the regs is very confusing and I admit to relying on the Shelter Guide .
