Premiums due to DLA never considered by BA/LA Wed 03-Mar-04 01:26 PM
I think I've seen similar before but can't find any details now. Client on IB only and awarded HRC in June 2002. He didn't claim IS and didn't advise LA and BA. Both agree they were aware (through RAT system). Client now missed out on sdp and edp for this lengthy period. Both refusing to backdate. I'm hoping to pursue appeals and would appreciate any info. Furthermore, LA say he omitted to tick box on his HB renewal forms to state if anyone claiming CA for looking after him - I know it's flimsy but surely this indicates an incomplete form and I'll argue that they should have queried it as they would have done if he had failed to complete any other of the questions. I can't see any other 'good cause' so am hoping for some ideas and would be grateful for any help. Thanks - Sue
