EEA Law & entitlement to Child Benefit and Child Tax Credit

I have a client from Latvia who has been in the country for three years. She has worked for nearly two of the three and paid national insurance for some of this period. She cannot work presently because of illhealth. She resides with partner who is British and working full time.

Her thirteen year old son has recently come to live with them intending to stay but may return back to Latvia to finish education.
Can mum claim Child benefit and Child Tax Credit. Can family claim Working Tax credit? My client claimed IB but contributions insufficient to qualify.

Have looked at CPAG Handbook but confused. Can anyone advise?. Thanks. Linda

Rather than get into the complexities of whether the mother currently has a right to reside.....

1. It is only the claimant of CB and CTC who needs a right to reside in order to be entitled.

2. So if the dad (who is British and therefore has a right to reside in the UK) claims CTC and CB the matter is made very simple.....

Forgot a bit:

If the child goes back to Latvia to finish education then they are still treated as present in UK.
