Hi i,ve a client who was awarded DLA 2004,he has cardio myopathy, a condition that affects his blood circulation severely, his condition is such that when in the UK his condition deteriorates to the extent that his life is apparently in danger.
To cut a long story short, his brother and sister bought an appartment for him to live in, in Spain. The warmth has a major impact on his circulation to the extent that he can function to a degree he could never achieve in the UK.
Although being in Spain has had beneficial and therapeutic affects way beyond what his specialist's prognosis suggested. He doesn't actually receive specific medical treatment, but is monitored by local doctors.
Can anyone see beyond the wording of the social security (DLA) REGS 2 (2) (e), as to any 'straws' of caselaw or definitions of the wording, lending any hope or ideas, or in this instance possibly devine inspiration or intervention.
