CHILD DLA & SCOLIOSIS

We have a 12 year young lady who suffers from Scoliosis of the spine - in her case she has a double or S shaped curvature - she has to wear a rigid plastic jacket known as a "boston brace".

Apart from from being best pleased about having to wear it for 90% of her waking day, she finds it causes chafing and soreness the more she moves about.

She is quite capable of seeing to her opwn care needs, but because of the soreness, chafeing etc, has problems walking any distance - ideally I would like to pursue high rate mobilty but I can't see an arguement to say that she is virtually unable to walk etc - so I guess we have to be looking at low rate mob ?

Anyone with experience of claiming for Scoliosis .....?

Unfortunatley unless your client requires someone to guide or supervise her she will not qualify for lower rate mobility.

Thought of that one just after I pressed the send button - as you do - however, we may have a better chance than i first thought, cos the little girl is now admitting to feeling pain and discomfort, which she would'nt do up until now - being 12, and wanting to keep up with her friends etc .............
Anyway, the trubunal have just adjourned as they want to meet the little maid and talk to her, if she'll agree to come along to the next hearing .......

I think that one problem you may encounter could be the tribunal wondering why the hospital can't make sure that the brace fits properly. Surely this would be a simple thing to correct.

"maid" is widely used in the West country and East Anglia, normally by us gud ole country folk, as a friendly term when referring to young ladies........

i figured as much, and thought it rather nice. and refreshingly unhomogenized. in Black Country, i'd have called her a 'wench' and offended everybody. : )
