Just a quick question. I should know the answer to this but it's been a long week and I just wanted to confirm this.
Tenant moved into rented accomodation from her own property. The property she has moved from is not on the market and her grandson lives in the property rent free at the moment. The grandson is in the process of trying to get a mortgage to buy the property. Once the grandson obtains a mortgage he will then buy the house which will mean that the grandmother will not be eligible for HB as capital will exceed the prescribed limits.
My question is how will the LA treat the other property for a current HB claim, bearing in mind the other property is not on the market and someone is living in it rent free at the moment?

Sounds like your client is taking reasonable steps to dispose of the property so should be disregarded until the sale goes through. Would be helpful if grandson could provide something confirming the steps he's taking to try to get a mortgage.
