Student nurses and WTC

Can anyone point me at any law which says a student nurse's work does not qualify as work because of the status of being a student? Thank you.

See the dicussion under "student nurse and NHS bursary" on "disability related benefits", started on 17/11/05, which may provide a useful starting point.

I think the key may be whether the nurse has a contract of employment with the NHS. Would this not then be classed as remunerative work (if over 16 hours).

Thank you for your help Paul which is very useful.

TCO info states that a student nurse is not entitled to WTC (unless they work for more than 16 hours a week in another job as well) _because_ they are a student. But there's no bar to a student claiming unlike IS / HB that I can see: just the rules on qualifying remunerative work.

Which is why I'd gone along the lines of looking at the relationship between the student and the place of work as you suggest.

But TCO advice is very clear: You will get nowhere with this. Which is why I wondered if I'd missed something.
