I'm looking for advice on tactics in a case. Client had been claiming ESA until Nov 09 when she received insufficient points following medical. She appealed, but her sick note ran out 23 December at which point payments stopped. She rang call centre who advised her to claim JSA. She claimed JSA on 4 January - she was not advised what to do about ESA claim which was technically still live as appeal was open. In mid-January she was advised to withdraw the appeal, which she did. On 8 March she had still received no JSA payments and she was advised (for the first time) to withdraw JSA claim and make a new claim. She is reluctant to do this as there is considerable doubt as to whether this would be backdated to 4 January. What is her best way forward - to withdraw existing claim and reclaim JSA or to persist with her existing claim.
